Kabn Company Terms and Conditions

Apologies for the formality and abundance of boring text but it is essential for your own safety and enjoyment that you take the time to read our Terms and Conditions for your booking and stay. Our Terms and Conditions must be read in full before booking.


A contract between you and Kabn Company will come into existence when payment is received and a booking confirmation is issued showing the confirmed holiday dates. The contract binds you and all the members of your party. It is your responsibility to ensure that all members of your party accept the terms of the contract set out in these Terms and Conditions of booking. Failure to disclose all relevant information or to comply with these terms may lead to termination of the contract and loss of the booking.


Disclaimer

Kabn Company accepts no responsibility for loss or damage of property, vehicles or vehicle contents or valuables belonging to guests during their stay or time at Kabn Company. 

Any personal items found will be held for a maximum of three months, following which they will be donated to charity or destroyed.

Kabn Company is located on Ardkinglas Estate. This is a working estate with commercial operations located close by. Please be conscious, careful and respectful of the land and the other residents who live and work there. Kabn Company shall have no responsibility for loss, damage or injury that occurs on the land or in the loch.

Although care has been taken in managing the various facilities, such as BBQs, fires, wood burning stoves and paddle boards, Kabn Company cannot be held responsible for any injury, loss or damage in relation to any services, features or facilities provided or supplied by us or third parties. You use these services, features, and facilities at your own risk.

Information about features, facilities, and services, is, to the best of our knowledge and belief, accurate at the time of publication, however, Kabn Company cannot guarantee that these services, features, and facilities will be available during your holiday.

To the maximum extent permitted by applicable law, you agree to release, defend (at Kabn Company’s option), indemnify, and hold Kabn Company (including its personnel) harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with: (i) your breach of these Terms and Conditions (including any supplemental or additional terms that apply), (ii) your improper use of the Kabns, (iii) your interaction with any other guest, your stay at the Kabns, participation in an experience or activity, including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction, stay, participation or use of the Kabns or any features, facilities and services, and (iv) your breach of any laws, regulations or third party rights.

Each guest agrees:

a. to fully indemnify Kabn Company for any losses or damage to the property caused or allowed by the guest;

b. to take good care of the property and leave it in a clean and tidy condition on departure. Kabn Company reserves the right to make a charge for extra cleaning if the property is not left in a satisfactory condition;

c. to permit Kabn Company and their agents reasonable access to the property at all times;

d. not to part with possession of the property, or share it, except with members of the party listed when booking;

e. not to exceed the total number of people stipulated in the property description;

f. not to cause an annoyance or become a nuisance to occupants of near-by premises; and

g. not to smoke or allow smoking in Kabn Company property and not to bring any pets to the property (unless explicitly permitted by Kabn Company during the trial period). 

The person booking the stay is responsible for the behaviour of all members of the party at all times and is responsible for ensuring they have read all the Terms and Conditions of the booking including instructions on how to use the Kabns and the features, facilities and services provided. 

Kabn Company reserves the right to refuse a booking without giving any reason.

NEVER plug an electric car charger into the power points, this will destroy the off-grid power system and the guest will be responsible for the cost of replacing the system

Payment

The full balance of your stay is due at the point of booking. Payment for bookings are made online through our third-party booking system. Payment is processed through Stripe. All major debit and credit cards are accepted. 

Booking is taken on a provisional basis until all funds have been paid in full and cleared through the payment system (Stripe). Until the booking is confirmed, it can be cancelled at any time with prior notice.

In making a booking you accept responsibility for any theft, breakage or damage caused by you or any member of your party and agree to indemnify us in full for any loss that we may incur as a result. A security deposit of £150 may be required and will be returned within 10-15 Business Days of the end of your holiday if taken, less the cost of any damage/breakages. Please do not take any items away from the Kabn with you and only use what you need. This includes all toiletries and amenities, which will be charged for if taken. Accidents do happen but please take due care of the Kabns and the furniture, fixtures, fittings, electronics and other contents, and leave them in the same state they were in when you arrived. If anything is broken, damaged or lost, make sure you report it promptly (and in any event before check-out) to Kabn Company via our Whatsapp Concierge. The accommodation will be inspected at the end of the holiday and you may be charged for any loss or damage. 

Prices 

The prices advertised are accurate at the time of booking. Kabn Company reserves the right to adjust the pricing in the future, but this will not apply to confirmed bookings. Prices include VAT at the current prevailing rate. 

Prices do not include any additional services unless expressly stated.

Promotions, deals or discounted offers are provided at the sole discretion of Kabn Company and may be revoked at any time. All offers are subject to availability and cannot be used in conjunction with any other offer or discount and may be withdrawn at any time. Retrospective refunds are not permitted against any offer or promotion advertised after such time a booking is made.

Payment in full is required at the time of the booking and will be subject to the cancellation policy set out in the terms and conditions.

Home Truths

Please make sure you read our FAQ and Home Truths sections prior to booking to ensure you are happy with the accommodation and level of service we are offering.

Maximum Occupancy

Strictly 2 adults per Kabn and only those listed on the booking form can occupy the property.

No persons under the age of 21 are allowed on site. Bookings cannot be accepted from persons under twenty one years of age.

No visitors, parties, events or gatherings may take place at the property at any time.

We reserve the right to terminate the booking without notice and without refund in case of a breach of these conditions.

Cancellation Policy

Any cancellation made by the customer must be made in writing by email directly to info@kabncompany.com

From your stay date:

90 + = Full Refund

90 to 30 days = 50% Refund*

30 days - stay date - No Refund

*If we are able to fill the dates at the same price, we will provide a full refund.

There may be a handling fee to process any refunds.

If you leave early for any reason, Kabn Company will not issue any refund.

Unfortunately, in some unforeseen circumstances e.g. a severe weather event, Kabn Company may have to cancel your booking. In these circumstances, notification of cancellation will be provided as soon as possible and we will offer you a full refund of any amounts paid or the option of booking an alternative date. No other compensation is available.

We strongly advise that guests take out an appropriate travel insurance policy or holiday cancellation insurance to protect yourself in an unlikely event (including Force Majeure) or sudden change of plans. 

Changing Length of the Stay

This may be possible if requested more than 4 weeks in advance of the booking and there is availability. Please get in touch with us directly to do this.

Arrival and Departure 

Check In: 3.30pm to 9.30pm. We advise checking in during sunlight hours so that you can familiarise yourself with the location and property.

Check Out: 10:30am, so that the property can be thoroughly cleaned and prepared for the next arrival.

Detailed directions of how to get to the Kabns and the location of the key safe will be provided with the booking confirmation. Keys must be returned to the key safe at the end of the stay.

Guests are kindly asked to leave the Kabns clean and tidy and in the same condition as they found the Kabns on arrival. This includes making sure all the kitchen equipment (e.g. pots, pans, plates etc.) and BBQ equipment is clean. We reserve the right to retain the security deposit if this is not the case. 

Drugs

Kabn Company has a strict zero tolerance policy on drugs and any illegal substances. If any guest is found to be under the influence, the booking will be terminated with immediate effect and the police will be notified.

Smoking

This is a non-smoking property. Vaping or smoking anywhere inside the premises or near to the Kabns will result in immediate termination of occupancy and forfeiture of all payments. This must be strictly adhered to and any damage or extra cleaning caused by smoking (including the removal of cigarette buts from the vicinity) will be at your expense. A flat fee of £300 will be charged to cover any cleaning expenses if there is any evidence of smoking within or around the property.

For your own safety and the safety of others, under no circumstances should you smoke inside, near or around the Kabns where there are flammable materials. 

Fires and Wood-burning Stoves

The wood burning stove, outdoor grill and BBQ are used entirely at the guest’s own risk. Kabn Company accepts no liability in relation to the guest’s use and operation of the wood burning stove, outdoor grill and BBQ. You will be liable for any loss, damage or injury caused to the property or its contents by use of the wood burning stove, grill and BBQ during your stay. 

We supply the charcoal (for the BBQ), logs for the outdoor fire grill and indoor logs, kindling and firelighters for the wood burning stove all free of charge. Wood is expensive and a limited resource so we therefore supply on a fair usage policy, if you would like to purchase more we can supply at the time of booking (subject to availability) alternatively extra wood can be purchased at the local 'Tree Shop' nursery next to Loch Fyne Oyster Deli. 

Outdoor fires: No fires shall be made on the beach or close to the Kabns other than in the designated Copper coloured outdoor fire grill. No plastic or any other flammable material of any kind must be used in the fire.

Never add too many logs to the outdoor grill or cause the fire to burn out of control.

Never leave the outdoor grill, wood burning stove or BBQ unattended when lit.

Barbecue – please use the designated barbecue utensils and clean the barbecue after use.

Always make sure the outdoor grill, wood burning stove and BBQ are safely put out after use.

Indoor Wood-burning Stove: For your own health and safety you must read and adhere to all instructions on how to light, use and operate the wood-burning stove, which will be included at the Kabn in a handbook.

Please only use the ‘indoor’ firewood and kindling provided, do not put any other material in the stove other than those provided and as instructed. Strictly no coal, charcoal, plastic or any other flammable material of any kind must be used in the wood-burning stove. 

Never leave the door to the wood burning stove open; always ensure it is firmly shut after logs are added. 

Never leave the wood-burning stove lit when outside the Kabn / unattended.

Always keep a close eye on the fire to ensure it is burning correctly, so no smoke is filling the room and that it is not too hot or the flame is too large.

In the unlikely event that an ember does fall out of the fire, please quickly use the fire tools and glove provided to collect and place back in the fire. The Kabns are made of wood which is flammable so please take great care. There is a fire extinguisher in each Kabn to be used in emergencies.

The stove handle becomes extremely hot so always use an oven glove (which is provided) to open/close the door and add one log at a time.

Carefully place the log in the fire so it will not fall out when the door is next opened. Also please take care of the baffle in the fire which can be dislodged if a lack of care is taken when adding logs. 

Do not touch the outside of the stove or place any objects on top of the stove.

The baking tray in the oven insert also gets EXTREMELY hot, so please handle with care and only pick up with the oven gloves. The glove does heat up quickly with the tray in your hand so please put the tray down on the hob or a trivet very quickly after picking up. Never get the oven glove wet or use when wet. Never put anything hot on any surface in the Kabn, other than the hob or a trivet.

Familiarise yourself with the ‘window door’ operation opposite the bed to make sure you understand how to use it in case of emergency as this offers an alternative route of escape from the front door. 

Safety Equipment 

We provide a basic first aid kit (in the bathroom under the sink), fire extinguishers (by the stove and under the worktop) and fire blanket (on the wall by the sink) incase of emergencies. These are all chargeable if used.

Motorised Watercraft

No motorised watercraft may be launched from Ardkinglas Estate land. This includes all land and the loch shores surrounding the Kabns.

Personal Electrical Equipment 

If you are using your own electrical equipment in any of the Kabns these must be:

Electrically safe, of sound design and not modified from their original purpose;

Show no signs of adaptation, overheating or poor maintenance;

Used in accordance with manufacturers instructions and at the user’s own risk.

Any high power consumption items like toasters, kettles and hairdryers are strictly prohibited and will break the off grid system. 

Please note that you will be liable for any loss, damage or injury caused to the property or its contents by the use of your own electrical equipment during your stay. 

Power

Our renewable power supply may occasionally stop working or indeed run out if too much has been used. In the case of such an event please promptly let us know via WhatsApp and we will endeavour to make you as comfortable as possible. However, no compensation will be payable as this is out of our control and is part of being off grid. High power consumption items like toasters, kettles and hairdryers are strictly prohibited (other than the hairdryer we provide) as they will break the system. We ask that you be as conservative as possible with your power usage, turning lights off when not in the property, keeping the bathroom lights off etc. 

Candles

Candles are not allowed inside the Kabns at any time. In the event of a power outage, you will find a torch in the Kabn beside the bed.

Fireworks or sky lanterns 

Fireworks and sky lanterns may not be used at any time. Kabn Company is on a working Estate and both fireworks and sky lanterns can cause physical damage as well as distress and death to surrounding livestock and also serve as a fire risk.

Staying With Us

Please maintain the security of the accommodation and its contents during your stay. Please lock doors when you leave.

Please ensure all windows are closed when you leave the Kabns and when it rains.

Please be careful when opening and closing the doors.

Any negligent or wilful damage to the site or any other Kabn Company or Ardkinglas Estate property will result in you being asked to immediately leave the site. If you are asked to leave under these circumstances, no monies will be refunded and you will be invoiced for any damage.

Pet Policy

House-trained, well behaved dogs are permitted only allowed during stays between 1st July and 28th February. At all other times, no dogs are allowed and bringing pets will result in immediate termination of occupancy and forfeiture of all payments. This must be strictly adhered to and any damage or extra cleaning caused by pets will be at your expense. A flat fee of £300 shall apply if there is any evidence that pets have been on the property.

We charge GBP 50 per dog per stay (up to a maximum of 3 dogs). This includes a GBP 5 donation to the Scottish SPCA.

Dogs must be kept under proper control at all times and are not allowed on the bed or any furniture in the Kabns at any time. Dogs must not be left unattended in the Kabns at any time. Dog owners will be held responsible for any damage caused to the property, contents or surrounding areas by their dog and for any extra cleaning required. Dogs which are banned under the Dangerous Dogs Act 1991 are not permitted.

Dog waste must be collected and disposed of in the bins provided.

This is a working Estate with livestock in fields and open fencing so dogs must be kept on leads or close to heal at all times. They must not be allowed to disturb people, livestock, deer, seals, game birds, hens, horses or ground-nesting birds. We do have a resident colony of seals that live on the shore by the Kabns - please do not allow your dog to chase or disturb the seals at any time.

Guests are fully liable for any issues that occur to their dogs whilst on the property, any issues with wildlife including bites and injury.

Kabn Company will not be held responsible for any liability or damage caused by dogs. Furthermore guests are responsible for any damage that their pets might cause to the Kabns or surrounding property or livestock and Kabn Company reserves the right to charge guests for any such damage caused. Please be respectful to other guests and residents who are there to enjoy peace and quiet.

Camping

Camping on the sites or the surrounding area is strictly prohibited.

Services, Amenities, and Facilities 

Our website displays all the services and amenities we provide.

We can also provide information about local activities, which can be booked directly with the providers.

You use these services, features, and facilities at your own risk and Kabn Company shall have no responsibility for loss, damage or injury in relation to any services, features or facilities provided or supplied by us or third parties.

Kabn Company shall not be liable for any temporary defect or malfunction of any equipment, machinery or appliance on the site.

No compensation will be given for any temporary outage of electricity, gas or water.

All inventory must remain in the property and not be taken to another property or off the site.

Please park your vehicles in the designated parking space.

Information about features, facilities and services, is, to the best of our knowledge and belief, accurate at the time of publication, however, Kabn Company cannot guarantee that these services, features and facilities will be available during your stay.

Information about you

By providing us with your personal information you consent to our processing your data for data analysis. We will only use the information that you provide to us for the purposes contemplated in these Terms and Conditions, informing you about similar services which we provide (unless you tell us that you do not want to receive this information) and improving the services which we offer to customers.

Our online booking and payment systems which store your data are password encrypted to protect your personal information from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage. We may retain your personal information after we have ceased using it for the purposes set out in these Terms and Conditions, or for as long as the law requires.

Internet Access

There is no wifi. We encourage guests to unplug and disconnect from the usual distractions of everyday life. 

Mobile Phones

There is mobile phone signal outside both Kabns, some handsets and providers get signal inside too.

Keys

There will be a £50.00 charge should a guest lose or damage keys or fail to leave them in the key safe at check-out. 

Noise Levels

Our guests visit Kabn Company to enjoy the peace and tranquility of the beautiful environment and surroundings. To respect other guests and residents nearby, please keep noise levels to a minimum at all times especially between 10pm and 8am.

We reserve the right to terminate a booking immediately and without compensation where the unreasonable behaviour of the persons named on the booking (or their guests) may impair the enjoyment, comfort or health of others.

Force Majeure

Kabn Company may have to make changes or cancel the booking for reason of Force Majeure, meaning unusual or unforeseeable circumstances beyond its control, the consequences of which neither our suppliers nor we could avoid. Example: industrial disputes, natural disaster, fire or adverse weather conditions, acts of God, malicious damage, flooding, acts of terrorism, frozen water pipes or similar events beyond our control. Kabn Company shall not be liable for any loss, damage or costs resulting from a Force Majeure event. 

Complaints 

If you have any complaints, gripes, annoyances, any questions whatsoever please let Kabn Company know immediately via our WhatsApp Concierge. The WhatsApp Concierge is available to you before, during and after your stay with us. Under no circumstances will compensation be made for complaints raised after the holiday period has ended, or when the guest has denied Kabn Company the opportunity to investigate the complaint and endeavour to put matters right during the holiday period.

Health and Safety

The wood burning stoves are regularly maintained and have been installed by a HETAS approved installer. The Boiler is regularly maintained and has been installed by a GasSafe engineer.

Foraging

Foraging for any wild items is prohibited on the Estate.

Prohibited Areas

Do not go near or touch the red Gas Canisters located to the rear of each Kabn.

Do not go near the solar equipment and container area, dangerous electrical hazards are located here and this area is clearly marked with a rope prohibiting access.

You will also be provided with a map in the welcome pack showing the areas which you are not allowed to enter on the wider Estate. This is a working Estate with commercial operations and hazards in the areas highlighted.

Use of CCTV

Kabn Company operates a CCTV surveillance system throughout the public areas outside the Kabns, with images being monitored and recorded at each Kabn location. Kabn Company uses a third party application [Reolink] to stream these images strictly for security and crime prevention purposes only. This data is only kept for 30 days and is then destroyed. Signage is prominently placed on site. The use of CCTV for the above purposes is also in our Terms and Conditions of staying at the Kabns. Access to images is restricted to those who need to have access in accordance with this policy. Disclosure of recorded material will only be made available to third parties in accordance with the purposes of the system and in compliance with the Data Protection Act. Anyone who believes that they have been filmed by the system can request a copy of the recording, subject to any restrictions covered by the Data Protection Act Subject access request.

Gift Vouchers

Valid for 12 months after purchase (i.e. must be redeemed within 12 months of purchase). 

Vouchers must be redeemed within the period of voucher validity. 

Kabn Company does not offer refunds for vouchers.

Vouchers are only redeemable for stays in Kabn 1 or Kabn 2 on Ardkinglas Estate.

Vouchers cannot be exchanged for cash.

Vouchers may not be used for the marketing of any other brands or businesses without written approval by Kabn Company.

It is the purchaser’s responsibility to ensure that the recipient of the voucher is aware of the Terms & Conditions that apply to the voucher and that the recipient of the voucher reads and agrees to the above Terms and Conditions of stays at Kabn Company. 

Multiple vouchers may be redeemed in the same transaction up to the value of the stay being purchased.

Expired vouchers will be treated as void and are non-exchangeable and non-refundable.

Vouchers cannot be returned or refunded.

The guest is free to request their preferred date within the voucher validity period, however, it is dependent on availability. To avoid disappointment we recommend that guests book well in advance. 

Kabn Company may occasionally be able to fit in a booking when a cancellation has occurred or on shorter notice. We recommend booking as early as possible and ask that you do not make any travel arrangements until you have received confirmation of your booking. Once a date has been booked with us, your voucher will be deemed to be used at that point.

Extension to the voucher validity period may be considered under exceptional circumstances and will be considered on a case by case basis in our sole discretion.

By purchasing a voucher you and your guests are agreeing to be bound to these Terms & Conditions.

VAT – All products and services shown are inclusive of VAT.

We reserve the right to make reasonable amendments or additions to these terms and conditions without notice.

Declaration 

I have read the terms and conditions of this booking and agree on behalf of all members of my party to abide by those conditions during my stay at Kabn Company. I understand that the invoice must be paid on initial booking of the Kabn and failure to do so may result in cancellation of my booking. I am over 21 years of age.
